Terms of Service

1. Eligibility & Authority

By creating an admin account and using Queuly, you represent that you are at least 18 years old, have the legal capacity to enter into a binding agreement, and, when using Queuly for a business or organization, have authority to act on its behalf.

2. Modifications to Terms

Queuly LLC may change or update these Terms of Service from time to time. Your continued use of the service after updated terms become effective constitutes acceptance of those terms.

3. Account & Queue Key Security

You are responsible for maintaining the confidentiality and security of your admin account and Queue Keys. Queue Keys grant operational access to the queues they are associated with.

If a Queue Key is lost, shared improperly, or suspected to be compromised, you are responsible for disabling, revoking, or regenerating it through the service. Queuly LLC may suspend access when we reasonably suspect fraud, abuse, illegal activity, or a violation of these terms.

4. Acceptable Use

You may use Queuly only for lawful queue management and related transactional communications. You may not use the service to send unlawful, deceptive, abusive, unsolicited marketing, or otherwise prohibited messages.

5. Messaging & Provider Compliance

Queuly uses third-party providers to deliver SMS notifications. When you enter a customer mobile number or send a message through Queuly, you are responsible for having the right and any required consent to contact that customer.

  • Transactional Use: Queue communications must relate to the customer's active queue experience or the service they requested from your business. These communications may include queue-status links, approximate wait information, and ready notifications.
  • Opt-Out: Customers may be able to opt out of messaging by replying STOP, and message and data rates may apply.
  • Missed Notifications: Queuly LLC is not responsible for notifications that are delayed, blocked, undeliverable, or not received because of carrier, device, network, opt-out, or third-party provider issues.

6. Customer Data, Import/Export & Retention

Queuly is designed for live queue management, not long-term customer record storage or customer relationship management. The service does not provide customer import or export tools. You are responsible for maintaining outside Queuly any business records you are legally or operationally required to keep.

Customer queue information for completed or removed queue entries may remain in Queuly's active application systems for up to 60 days before automatic deletion. Admin account, billing, security, legal, compliance, backup, and third-party provider records may be retained under different retention periods.

7. Billing & Cancellation

Payments are processed through Stripe. You authorize recurring subscription charges until you cancel. Each plan includes a monthly SMS notification allowance. Plan limits are based on active queue capacity and SMS notification allowances, not visits or queue entries. A text-enabled guest may use more than one notification, such as a queue-status link and a ready notification. When the allowance is reached, Queuly pauses SMS notifications until the allowance resets or you upgrade. Queue management remains available, and you may continue to add and manage queue entries, including customer phone numbers. Staff may use the phone number shown on a queue entry to contact the customer outside Queuly. Queuly does not place those calls, and you are responsible for communications made outside the service. Queuly's current plans do not charge SMS overages. Fees already charged are non-refundable except where required by law or expressly stated otherwise.

8. Service Availability & Limitation of Liability

Queuly is provided on an "as-is" and "as-available" basis. Queuly LLC does not guarantee uninterrupted availability or delivery of every notification and is not liable for lost business income, revenue, reputation, or other indirect or consequential damages to the maximum extent permitted by law.

9. Dispute Resolution

Any disputes shall be handled through binding arbitration outside of the court system at your own expense. You waive the right to participate in class-action lawsuits, except where such a waiver is prohibited by applicable law.

10. Legal Ownership & Business Identity

Queuly is owned and operated by Queuly LLC, an Ohio limited liability company. Application logic, service infrastructure, content, and branding remain the property of Queuly LLC or their respective licensors. For billing, compliance, or technical inquiries, contact support@queuly.com.
